If you find that your paycheck has been garnished, or your bank account is frozen, you may be wondering why—or you’ve already called and found out that a writ of garnishment was issued and that is why your funds frozen or being taken.  You should call an experienced garnishment defense attorney for advice on how to stop your wages or bank account from being garnished.

A continuing writ of garnishment is a document that gets issued by the court and allows the creditor or judgment holder to collect money from you.  The writ process happens“behind the scenes”, meaning you were likely not provided notice of the writ.

It is scary situation, but we may be able to help.  You may be entitled to protections that would make you exempt from garnishment. Florida provides relief for the head of household, or “head of family”,and if you provide more than one-half of the support for a dependent, you maybe exempt from garnishment and must file a Claim of Exemption.  You must act quickly though.  There are strict deadlines that must be adhered to, and we recommend you contact Attorney Joe Taormina or one of the other wage and bank account attorneys at our firm.

We work in Seminole, Orange, Brevard, Volusia, Pinellas, and many other counties across Florida and with most courts implementing telephonic and video hearings, we can cover even more counties and provide garnishment and other debtor defense service to more clients.

We make it easy to schedule a remote consultation with Attorney Joe Taormina one of our attorneys and can usually handle the intake process over the phone.  We can send documents to you for e-signature and can process payments online through our secured portal.
